These terms are an agreement between you and Restaurant Logic LLC ("we," "us"), which operates VideoWishes at videowishes.com. By creating an account, setting up an event, or recording a message, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use VideoWishes.
Hosts create an event, design a card, and share a recording link by QR code, text, or email. Guests open the link on their own phone and record a short video message, which appears in the host's gallery for viewing and download. Features may change over time.
You must be at least 18 to create a host account. Keep your sign-in details secure; you're responsible for activity in your account. Give us accurate information and keep your email address current.
VideoWishes is free for a limited time while we launch. If we introduce paid plans, we'll show the price before you're charged, and we won't charge you for anything you haven't agreed to. TODO: add payment, refund, and cancellation terms when paid plans go live
Guests keep ownership of the messages they record. By sending a message, a guest:

VideoWishes isn't a backup service. Download the messages you want to keep. We may introduce storage time limits in the future; if we do, we'll tell hosts in advance so they can download their messages. TODO: align with the retention decision in the Privacy Policy
VideoWishes, including its design, software, and branding, belongs to Restaurant Logic LLC. These terms don't give you any rights to it beyond using the service as intended.
You can stop using VideoWishes at any time and ask us to delete your account by emailing privacy@videowishes.com TODO: confirm this inbox exists and is monitored. We may suspend or end access if you break these terms or if we discontinue the service; if we discontinue it, we'll give hosts reasonable notice to download their messages where we can.
VideoWishes is provided "as is" and "as available." Recording depends on guests' phones, browsers, and internet connections, which we don't control, and we can't promise every message will be captured or that the service will be uninterrupted or error-free. To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
To the extent the law allows, Restaurant Logic LLC won't be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost recordings, or lost profits. Our total liability for any claim related to VideoWishes is limited to the greater of the amount you paid us in the 12 months before the claim or $100. TODO: confirm liability cap with counsel
If someone brings a claim against us because of content you uploaded or your breach of these terms, you agree to cover our reasonable costs and losses from that claim, to the extent the law allows.
These terms are governed by the laws of the State of Michigan, without regard to its conflict-of-law rules. Any dispute will be resolved in the state courts located in Oakland County, Michigan, and you and we agree to those courts' jurisdiction. We may update these terms. We'll change the date at the top, and for significant changes we'll let hosts know by email or on the site. Continuing to use VideoWishes after changes take effect means you accept them.
